1. Introduction
Overview
1.1 We recognise the importance of protecting your privacy. This Privacy Statement (Privacy Statement) describes the privacy practices of Road Ninja and tells you how we collect, store, use and disclose any personal information that you provide to us, or authorise us to collect, in connection with Log Ninja.
1.2 We encourage you to read this Privacy Statement carefully so that you understand our information handling practices. By accessing Log Ninja, contacting us about Log Ninja, or otherwise providing us with personal information, you authorise us to collect, use and disclose your personal information in accordance with this Privacy Statement.
1.3 This Privacy Statement applies in addition to, and does not limit, the Privacy Act 2020 or any other applicable laws or regulation.
1.4 Log Ninja is operated by Road Ninja. Capitalised words that are used and not defined in this Privacy Statement have the meaning given to them in the Dictionary in Log Ninja Terms of Use (Terms).
1.5 We may update this Privacy Statement at any time (see further detail below).
Important Notice: New Zealand residents
1.6 Log Ninja and our other services are intended for New Zealand residents only. If you are located in another country you may be subject to other laws, including data protection laws. For that reason, if you are not located in New Zealand you are not permitted to use, and must immediately cease using, Log Ninja and other services.
2. Collection of personal information we collect
Types of personal information we collect
2.1 In order to provide you with access to Log Ninja, and to enable you to use Log Ninja, we may collect and use personal information about you. You are not required to provide us with any personal information that we request. However, if you do not do so, we may not be able to provide certain services to you.
2.2 The personal information we collect will vary depending on the services that you use and your interactions with us. For example, we may collect your:
contact information, including your name, email and phone number;
drivers licence, type / make of vehicle, vehicle registration and company details;
user information, including your IP address, browsing history and other device or internet information;
driving history that you log on Log Ninja;
login credentials for your Log Ninja account; and
any other personal information that you provide to us when you use Log Ninja or communicate with us.
2.3 There is no charge for your use of Log Ninja and accordingly we do not collect any payment or identification information.
How we collect your personal information
2.4 We generally collect your personal information directly from you. For example, when you engage with us using Log Ninja or use services provided by our related companies or businesses from time to time (including Road Ninja). We may also collect information using cookies (see further detail below).
2.5 We do not generally collect information from third parties. However, we may do so where permitted or required to do so by applicable law.
2.6 You must not provide us with personal information about any other person.
Analytics and Cookies
2.7 When you use Log Ninja we may also collect information that does not identify you (or any other individual), such as analytical information about the mobile device used and its use of Log Ninja. We use the information for statistical reporting and analytics and do not link it to any named individuals.
2.8 For example, data about your visit, based on your IP address, may be automatically logged. This information may be used to see where Log Ninja is being used to ensure coverage, and for click stream analysis to help better understand and design Log Ninja.
2.9 When you use Log Ninja, short text files called “cookies” may be automatically downloaded to your mobile device. Cookies enable us and our third party service providers to provide you with a better experience. For example, by enabling Log Ninja to know that you have visited before and in some cases to record preferences in order to personalise your visit. Cookies also assist us and our third party service providers to analyse the profile of our visitors. These can be session cookies which are deleted when you exit Log Ninja and/or persistent cookies which remain on your mobile device for a longer period of time. In a few cases blocking cookies may reduce the functionality of Log Ninja or otherwise prevent access to them depending on your chosen browser options. 3. Use of personal information
3.1 We may use your personal information for the following purposes:
facilitating your use of Log Ninja;
responding to any communications from you;
performing analytics and research to improve, develop and protect Log Ninja;
informing you about updates or important information about Log Ninja;
marketing our services to you and sending you information about other goods and services that we think might be of interest to you (unless you have opted out of receiving any marketing communications); and
complying with our legal and regulatory requirements and record keeping practices.
3.2 We may also use any information that we collect, in accordance with applicable law, to improve our products and services, for statistical and research purposes, and for general information purposes including to provide industry and market insights. Any information that we disclose or publish will be in a fully aggregated and de-identified form (to ensure that it does not identify any individuals). 3.3 We may communicate with you by email and other electronic means.
4. Disclosure of personal information
4.1 We may share your personal information with the following parties:
our related companies or businesses from time to time (including Road Ninja), who may use your personal information in accordance with their privacy statement, including to send you information about their goods and services (unless you have opted out of receiving any marketing communications) (for further information about Road Ninja refer to Road Ninja’s Privacy Statement);
service providers or other third parties for the purposes outlined in this Privacy Statement; and
any other party authorised by you or to whom we are required or authorised to disclose personal information in accordance with applicable law or regulation (including to Waka Kotahi if required by Waka Kotahi NZ Transport Agency).
5. Storage of personal information
Security and storage
5.1 Security of your personal information is very important to us. We take reasonable technical and organisational safeguards to protect personal information that we hold. However, due to the inherent nature of the internet, we are not able to guarantee the security of any information that we hold or that you transmit to us.
5.2 If you disclose your log book information with any third party (including, an employer), or enable any third party to access your log book information, we are no longer have any responsibility for that information, including the security of that information.
5.3 Personal information that we collect is either held by us at our head office or on our behalf by a group company or cloud services provider.
Updates
5.4 We rely on you to ensure that the personal information we hold is accurate and up to date. To assist us in this, you need to provide accurate, current and complete information to us and update us if your details change.
6. Accessing and correcting your personal information
You have a right to request access to, or the correction of, your personal information that we hold about you, subject to the requirements of the Privacy Act. Please contact us via our contact details at section 9, below.
7. Retention and deletion of personal information
7.1 We retain your data for as long as necessary in order to provide you with our services and comply with our legal and regulatory obligations and record keeping practices.
7.2 You may request that we close your account, in accordance with our Terms (through the Log Ninja App or by emailing support@roadninja.co.nz) at any time and, as part of that request, you may request that we delete your data. Following a deletion request, we will delete your data as requested, unless we consider it necessary to retain that information (for example, if we are legally required to keep that information for a minimum period). Where we agree to delete your data, we will generally do so within 90 days of your deletion request. Refer to our Terms for further information about retention of your Log Ninja account data after you Log Ninja account is closed.
8. Changes to this Privacy Statement
We may update this Privacy Statement at any time by posting an updated version on Log Ninja. The updated version of this Privacy Statement will take effect immediately upon publication (or, if applicable, on the date specified in the updated Privacy Statement) and will apply to all personal information that we hold about you. If the changes are material, we may also take additional steps to bring the changes to your attention, including by notifying you directly. We will update you of any material changes as required by law.
